Esguerra JHR has extensive experience advising trust companies and trustors in both trust agreements and commercial trust contracts (in their several modalities).

We have specific experience in supporting private and public trust companies in the structuring and implementation of commercial trust agreements for the administration of public resources related to construction projects and operation of social security systems, among others (such as FOSYGA or FONPET).

In addition, we provide advice on the identification, mitigation, and coverage of the various risks associated with the administration of public resources through trust vehicles, administrative, fiscal, and civil risks. Consequently, we represent several of our clients, trust companies, in administrative sanctioning, tax liability, and judicial processes (including civil and popular action processes).

We also have extensive experience in structuring trust businesses with private resources to develop real estate and business projects of several types, among others, and to guarantee or serve as a source of payment of obligations and manage resources. We also represent our clients and trustors in judicial and arbitration proceedings arising from controversies related to the entering into of trust agreements and underlying private agreements.
